Who Needs a Certificate of Authorization?
Firms providing or offering to provide Professional Engineering, Professional Surveying or Professional Engineering AND Professional Surveying services in Ohio need a Certificate of Authorization from the Board. The legal requirement stems from ORC Section 4733.16.
Recent Law Change
Effective May 15, 2005, the law reads: "Each firm, partnership, association, limited liability company, or corporation through which professional engineering or professional surveying services are offered or provided in this state shall designate one or more full-time partners, managers, members, officers, or directors as being responsible for and in responsible charge of the professional engineering or professional surveying activities and decisions, and those designated persons shall be registered in this state."
The new law makes two changes:
- The Ohio PE or PS you designate in responsible charge of engineering or surveying services on the 2nd page of the application must sign the application and be a full time (minimum 30 hours a week) employee of the firm applying for the certificate.
- Corporations applying for a certificate of authorization no longer need the designated Ohio PE or PS on the corporate Board of Directors.
